Brazil's Strategy in the WTO’S Dispute Settlement Mechanism: Full Litigation, Suspension or Settlement?

Heeft u zich ooit al afgevraagd waarom pompelmoezen in onze supermarkten helemaal uit Florida komen? Waarom kon je enkele jaren geleden amper rietsuiker vinden in de winkels en smaakte onze caipirinha nooit zo goed als in Brazilië? Ligt het aan de stijgende populariteit van Brazilië dat er nu plots zelfs vijf soorten Braziliaanse rietsuiker verkrijgbaar zijn of zijn er ook andere factoren in het spel? Een blik op het handelsbeleid kan ook wat verklaren. Feit is dat Brazilië een rechtszaak won tegen illegale subsidies aan de Europese suikersector. Daardoor konden Braziliaanse suikerproducenten vroeger niet concurreren op de Europese markt.

In de gespecialiseerde rechtbank van de Wereldhandelsorganisatie klagen landen ongewettigd protectionisme aan om zo een eerlijke concurrentiepositie te verkrijgen voor hun producten. Maar wat gebeurt er nu precies tijdens zo’n rechtszaak? Sommige zaken worden nooit afgehandeld, de twee partijen sluiten dan een compromis. Andere worden wel doorgezet tot de rechter een uitspraak doet. Deze masterproef onderzoekt Brazilië’s keuze tussen het doorduwen of het vroegtijdig afbreken van een rechtszaak.

Brazilië zet rechtszaken tegen ontwikkelingslanden sneller stop om tot een onderhandelde oplossing te komen. Bij sterke tegenstanders, zoals de Europese Unie en de Verenigde Staten, is de kans groter dat het toch tot een gerechtelijke uitspraak komt. Macht is belangrijk tijdens onderhandelingen, de sterkste probeert zijn wil door te drukken. Voor de rechtbank zijn beide partijen echter gelijk. Daarom zullen zwakke landen sneller toegeven aan Braziliaanse eisen. Bij sterke tegenstanders die geen compromis aanvaarden moet Brazilië de procedure wel doorzetten.

Ook sectoren spelen een rol in Brazilië’s beslissing om rechtszaken door te duwen: zaken over landbouw eindigen vaak met een uitspraak van de rechter, terwijl voor zaken gerelateerd aan industriegoederen vaker een oplossing wordt onderhandeld. Opvallend is dat deze sectoren helemaal niet de grootste sectoren zijn in de Braziliaanse economie. Landbouw en industrie zijn anderzijds politiek goed georganiseerd en lobbyen bij de regering. Deze sectoren zetten de regering onder druk om zaken op te starten en verder naar hun hand te zetten. Braziliaanse bedrijven betalen soms zelfs de dure advocaten. Wanneer de tegenpartij een voorstel doet, zal het ook de sector in kwestie moeten vooruithelpen of het bod zal niet aanvaard worden (zelfs als het misschien wel goed is voor Brazilië en de Braziliaanse regering).

Brazilië veranderde de laatste jaren heel duidelijk van strategie. Vroeger werden zaken meestal opgelost door een compromis, nu veelal door een uitspraak van de rechtbank. Nader onderzoek toonde dat eerst voornamelijk industriezaken werden aangespannen, waaronder enkele tegen ontwikkelingslanden. Later evolueerde dit naar het inspannen van landbouwzaken tegen ontwikkelde landen. Een reden kan gevonden worden in het feit dat de Braziliaanse industriesector minder druk zet op de regering om nieuwe zaken op te starten. Door de sterke stijging van de Braziliaanse munt (de real) krijgt de sector het moeilijk om te concurreren en proberen de industriebedrijven ervoor te zorgen dat Brazilië zijn markt beschermt tegen goedkope buitenlandse goederen. Braziliaanse landbouwproducten zijn wél heel competitief op de wereldmarkt. De Europese Unie en de Verenigde Staten heffen echter hoge tarieven op landbouwproducten. Wanneer deze landen de internationale regels breken, grijpt Brazilië zijn kans door via een rechtszaak zijn producten op deze markten te introduceren. Dit is precies wat Brazilië deed met suiker: Europa gaf illegale exportsubsidies aan de sector, waardoor Braziliaanse suiker niet op de Europese markt kon concurreren. Na een lange rechtszaak moest Europa inbinden, waardoor Braziliaanse rietsuiker plots goedkoper werd en nu vinden we dit in onze winkels.
