Misconduct by United Nations peacekeeping personnel, a legal analysis.

De schandvlek van de Verenigde Naties

Vredesoperaties van de Verenigde Naties hebben als doel de vrede te bewaren in (potentiële) conflictsituaties. VN blauwhelmen vervullen daarbij een essentiële rol door het uitvoeren van civiele, politionele en militaire opdrachten. Sinds de jaren ’90 duiken er echter regelmatig verhalen op waarbij vredestroepen worden beschuldigd van criminele feiten ten aanzien van de lokale bevolking. Helaas is het momenteel erg moeilijk om crimineel gedrag van VN blauwhelmen adequaat aan te pakken.

Een jammerlijk voorbeeld is het wangedrag van VN personeel tijdens de vredesoperatie in Congo. Uit gesprekken met de Congolese bevolking in 2004 bleek dat er heel wat seksuele contacten waren tussen de lokale bevolking en blauwhelmen, waaronder ook gevallen van seksuele uitbuiting en seksueel misbruik. Voornamelijk zogenaamd ‘transactionele seks’ kwam vaak voor. Daarbij gebruiken lokale vrouwen en meisjes seksuele handelingen als ruilmiddel voor voedsel of geld. Zo gaven blauwhelmen vaak 1 of 2 US dollar of een aantal eieren in ruil voor seksuele gunsten van lokale vrouwen en meisjes. In plaats van de lokale bevolking de noodzakelijke bescherming te bieden, misbruikte een deel van het VN personeel hun machtspositie voor verderfelijke doeleinden.

De VN bleef gelukkig niet bij de pakken zitten en ondernam actie in de daaropvolgende jaren. Het rapport van Prins Zeid in 2005 vormde de aanzet tot een aantal VN initiatieven om het crimineel gedrag van vredestroepen te bestrijden. Helaas blijkt uit recente rapporten dat de problemen verre van opgelost zijn. Nog steeds worden misdrijven gepleegd en worden lokale vrouwen en meisjes seksueel uitgebuit en misbruikt.

Straffeloosheid van militaire blauwhelmen

Het onderzoek in het kader van mijn masterproef spitste zich toe op het wangedrag van militaire blauwhelmen. Uit een analyse van het regulerend kader bleek dat een aantal zaken hun strafrechtelijke aansprakelijkheid verhindert of toch op z’n minst bemoeilijkt. Zo meldt de lokale bevolking niet elk incident, worden beschuldigingen weinig transparant afgehandeld, neemt het onderzoek te veel tijd in beslag en is er een algemeen gebrek aan vertrouwen vanwege de bevolking. Het grootste probleem is echter de afhankelijkheid van de zogenaamde zendstaten, de landen die de vredestroepen leveren.

Zendstaten zijn exclusief bevoegd om criminele feiten gepleegd door militair vredespersoneel te vervolgen. Dit betekent dat enkel zendstaten militaire blauwhelmen kunnen straffen voor misdrijven die zij plegen tijden een VN vredesoperatie. Wanneer een Belgische militaire blauwhelm een Congolees tienermeisje verkracht in Kinshasa, kan noch de VN noch Congo iets ondernemen tegen de verkrachter in kwestie. Enkel België kan die persoon strafrechtelijk vervolgen en terechtstellen.

Als tegenprestatie moeten deze landen weliswaar garanderen dat ze hun bevoegdheid ook daadwerkelijk kunnen en zullen uitoefenen. Hier wringt momenteel het schoentje. Deze garanties zijn immers niet veel waard doordat de huidige regeling geen procedure voorziet om zendstaten te bestraffen indien zij hun beloftes niet nakomen. België zal in bovenstaand voorbeeld met andere woorden niet worden aangepakt indien het geen stappen onderneemt tegen de blauwhelm die het Congolees meisje verkrachtte. Bijgevolg opteren zendstaten er in de praktijk vaak voor om het wangedrag van hun blauwhelmen niet of amper aan te pakken. Het resultaat is een cultuur van straffeloosheid bij het militair vredespersoneel.

Hervormingen zijn noodzakelijk

Deze straffeloosheid dient eerst en vooral te worden aangepakt om bijkomend leed voor slachtoffers te voorkomen. Daarnaast beschadigen verhalen van misbruik en uitbuiting door blauwhelmen het imago van de VN en haar vredesoperaties. Dit heeft niet alleen kwalijke gevolgen voor de VN zelf, maar kan er ook toe leiden dat een land in de toekomst niet de hulp zal kunnen krijgen die het nodig heeft.

Dé vraag is dan ook hoe de huidige straffeloosheid kan worden aangepakt. In mijn masterproef bespreek ik een aantal hervormingen die de strafrechtelijke aansprakelijkheid van militaire blauwhelmen zouden verhogen.

Nieuwe procedure voor het behandelen van beschuldigingen

Naast het verbeteren van het contact tussen de vredestroepen en de lokale bevolking en het doorvoeren van een aantal wijzigingen inzake de organisatie van de vredestroepen, is voornamelijk een nieuwe procedure voor het behandelen van beschuldigingen van groot belang. Zowel het onderzoek van beschuldigingen als de vervolging van militair vredespersoneel moet grondig worden geherstructureerd.

Met het oog op deze vernieuwing dient er binnen de VN een nieuw orgaan te worden opgericht. De voornaamste taak van het orgaan, dat ik ‘Central Office regarding Allegations of Misconduct by Peacekeepers’ (CAMP) noem, wordt het coördineren van de behandeling van beschuldigingen. Indien een Congolees tienermeisje een militaire blauwhelm van verkrachting beschuldigt, neemt CAMP de zaak in handen: het onderzoekt de feiten en coördineert de vervolging van de blauwhelm in kwestie.

In mijn voorstel worden beschuldigingen onderzocht door een onafhankelijk onderzoeksteam dat integraal deel uitmaakt van CAMP. Dit zorgt ervoor dat het onderzoek snel, onpartijdig en grondig kan worden uitgevoerd door een team van experten.

Wat betreft de vervolging van blauwhelmen behoudt de zendstaat een centrale rol, op voorwaarde dat het haar verantwoordelijkheid opneemt. Ik stel immers voor dat de zendstaat de primaire bevoegdheid krijgt met betrekking tot crimineel wangedrag van haar militair vredespersoneel. Dit houdt in dat de zendstaat als eerste de mogelijkheid heeft om haar blauwhelm te vervolgen. Indien het land echter geen stappen onderneemt, wordt een internationaal tribunaal subsidiair bevoegd om zich uit te spreken over het misdrijf in kwestie. Het internationaal tribunaal is dus bevoegd om een beschuldigde blauwhelm te vervolgen indien de zendstaat niks doet. Dit zorgt ervoor dat de uiteindelijke vervolging van blauwhelmen niet langer enkel en alleen afhankelijk is van de zendstaat. Het Internationaal Strafhof te Den Haag zou, mits een aantal aanpassingen, een meer dan geschikt forum kunnen zijn voor het uitvoeren van deze belangrijke taak.

Terug naar een VN om trots op te zijn

De hervormingen die ik voorstel zijn op een aantal vlakken vrij ambitieus. Indien men de straffeloosheid van vredestroepen echter grondig wil aanpakken, zijn ze uiterst noodzakelijk. De VN moet, in samenspraak met zend- en gaststaten, dringend actie ondernemen om het regulerend kader van militair vredespersoneel te wijzigen. Het is de plicht van de VN om er werkelijk alles aan te doen om het crimineel gedrag van haar blauwhelmen uit te roeien.
