Het oude conflict tussen China en Taiwan: wat met de zee?

Inleiding

Wanneer we praten over China en Taiwan, denken we vooral aan: “Chinese invasie van Taiwan”, “unificatie van Taiwan en China”, “status quo” of “de onafhankelijkheid van Taiwan”. Deze woorden beschrijven enkele mogelijke uitkomsten van het China-Taiwan-conflict, maar een vaak verwaarloosd aspect van deze onenigheid en de evolutie hiervan zijn de maritiem gerelateerde problemen die resulteren uit het conflict. De hoofdveronderstelling van mijn thesis is dat de huidige status van de relatie tussen China en Taiwan (i.e. de continuatie van de status quo) alleen maar tijdelijk is en dat het conflict uiteindelijk zal evolueren. Het doel van mijn thesis is (om) de toekomstige potentiële maritiem gerelateerde problemen die kunnen volgen uit de evolutie van het China-Taiwan-conflict te beoordelen (naast de beoordelingen die al reeds bestaan), gebaseerd op enkele scenario’s en daarop nieuwe oplossingen te vinden, voornamelijk gebaseerd op de toepassing van het Verdrag van de Verenigde Naties inzake het recht van de zee van 1982 (hierna afgekort als UNCLOS).

 

Belangrijkste kwesties en oplossingen

Een van de belangrijkste actuele kwesties in de Straat van Taiwan is dat, hoewel de maritieme wetgeving van China en Taiwan grotendeels in overeenstemming is met de UNCLOS, ze beide bepalingen bevatten die er in strijd mee zijn. Sommige van deze bepalingen vormen een bedreiging van wisselend belang voor het internationaal erkende beginsel van de vrijheid van scheepvaart. Daarnaast hebben zowel China en Taiwan hun grenzen voor hun respectieve maritieme domeinen zodanig getekend dat de gebieden waar ze veel soevereiniteit genieten (binnenwateren en territoriale zeeën) verder strekken dan zou moeten als de beginselen van UNCLOS zouden zijn gevolgd. De twee voornoemde problemen stapelen zich dus op. Inderdaad, in binnenwateren en territoriale zeeën wordt de vrijheid van scheepsvaart al beperkt door de principes uiteengezet door de UNCLOS. Maar daarnaast wordt deze vrijheid verder beperkt door de wettelijke bepalingen van zowel China als Taiwan (deze bepalingen zijn in strijd met UNCLOS), en zijn de beperkingen van toepassing op zeegebieden die ten onrechte zijn opgeëist als binnenwateren en territoriale zeeën door beide partijen. Deze juridische context kennende, is de volgende stap van mijn thesis proberen te bepalen wat zou gebeuren als het conflict tussen China en Taiwan zou evolueren of opgelost geraken. Dit wordt gebaseerd op drie mogelijke scenario’s: de onafhankelijkheid van Taiwan, de hereniging van China en Taiwan, en de voortzetting van de status quo (dit laatste impliceert meer een evolutie van het conflict dan een echte oplossing). De eerste twee scenario’s zouden juridisch gezien de meest uitdagende zijn als het een of het ander werkelijkheid zou worden. Daardoor zal een significant deel van mijn thesis bestaan uit het vinden van manieren om deze scenario’s compatibel te maken met de UNCLOS. Dit omvat onder andere voorstellen om de problematische wetsartikelen van China en Taiwan te modificeren, en pogingen om nieuwe maritieme grenzen te tekenen die in overeenstemming zijn met UNCLOS. Wat betreft het scenario waarbij de status-quo wordt voortgezet, zijn mijn voornaamste bevindingen dat de oplossingen voor de scenario’s van de onafhankelijkheid van Taiwan en de hereniging van China en Taiwan ook in het derde scenario van toepassing zijn. Zowel China als Taiwan zouden de relevante oplossingen in de praktijk kunnen brengen in afwachting van een echte oplossing van hun conflict, of het nu gaat om onafhankelijkheid van Taiwan of de hereniging.

 

Grotere kwesties, minder oplossingen

Er moet echter op gewezen worden dat het conflict tussen China en Taiwan en de ontwikkeling of oplossing ervan een grotere impact heeft dan alleen de Straat van Taiwan zelf. Beide partijen zijn immers betrokken bij het bekende en zeer ingewikkelde conflict in de Zuid-Chinese Zee. Hoewel ik ervoor heb gekozen om niet te veel in detail te treden bij kwesties die betrekking hebben op het conflict in de Zuid-Chinese Zee (vooral omdat het zo'n complexe kwestie is dat er een hele scriptie over geschreven zou kunnen worden, en ook omdat de kern van het conflict in de Zuid-Chinese Zee buiten het bestek van mijn scriptie valt), lijkt het erop dat zowel de onafhankelijkheid van Taiwan als de hereniging van China en Taiwan de kwesties in de Zuid-Chinese Zee zouden kunnen verergeren. Het vinden van oplossingen voor dat conflict is zeker geen gemakkelijke taak, bovendien geeft de UNCLOS mogelijk niet op elk aspect voldoende antwoorden. Het kan echter wel mogelijk zijn om tijdelijke oplossingen te vinden om de spanningen te verlichten, in afwachting van een daadwerkelijke oplossing van het conflict in de Zuid-Chinese Zee. Er zou echter een belangrijke kwestie blijven bestaan: alle partijen in het conflict zouden tot een akkoord moeten komen, en zoiets is nog lang niet zeker.

 

Conclusie

Samenvattend kan worden gesteld dat het conflict tussen China en Taiwan een aantal juridische uitdagingen met betrekking tot maritieme kwesties met zich meebrengt als het gaat om de ontwikkeling of oplossing ervan. Deze uitdagingen hebben een brede impact, en het vinden van oplossingen is vandaag de dag niet altijd mogelijk. Hoewel voor sommige kwesties oplossingen kunnen worden gevonden in het internationaal recht (onder andere in de UNCLOS), is dit niet voor elk aspect van het conflict het geval. Er kunnen natuurlijk veel veronderstellingen worden gemaakt, maar tot nu toe is het moeilijk te raden hoe de zaken er in de toekomst zullen uitzien, gezien de complexiteit van het conflict tussen China en Taiwan en alle aspecten die daarbij komen kijken...
